Terms of Use

These Terms of Use ("Terms") govern your use of the software applications distributed by AB Apps ("we", "us", "our") through the Atlassian Marketplace, including Team Reminders for Jira and Approval Nudge for Jira Service Management, together with any updates and related documentation (each, an "App"). By installing or using an App, you agree to these Terms.

1. Licence

Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App within your own Atlassian products, for your internal business purposes, for as long as your valid installation (and, for a paid App, your active subscription) remains in effect.

2. Restrictions

You will not, and will not permit others to:

• copy, modify, translate, or create derivative works of the App, except as expressly permitted by law;
• reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law;
• rent, lease, sell, sublicense, or otherwise commercially redistribute the App to third parties;
• remove or obscure any proprietary notices; or
• use the App to violate any law, infringe any third party's rights, or in a way that disrupts or degrades the Atlassian platform or other users.

3. Intellectual property

The App, and all intellectual property rights in it, are and remain owned by AB Apps and its licensors. Except for the licence expressly granted above, no rights are transferred to you. "Jira", "Jira Service Management", and "Forge" are trademarks of Atlassian Pty Ltd, used here only to describe compatibility; AB Apps is independent and not affiliated with or endorsed by Atlassian.

4. Your data

The Apps run entirely on the Atlassian Forge platform and store only minimal configuration and state in Atlassian-hosted Forge storage inside your Atlassian instance. We do not export your data outside Atlassian. Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for your use of the App and for your data within your Atlassian products.

5. Platform dependency

The Apps depend on the Atlassian platform and its APIs, which are provided by Atlassian and may change, be deprecated, or become unavailable outside our control. Some functionality may rely on Atlassian APIs that Atlassian designates as experimental and may change without notice. We are not responsible for interruptions, changes, or data loss caused by the Atlassian platform, your configuration, or third parties.

6. Fees and billing

Where an App is offered as a paid App, pricing is displayed on its Atlassian Marketplace listing, and all billing, taxes, refunds, and payment processing are handled by Atlassian as the merchant of record under the Atlassian Marketplace terms. We do not receive or store your payment details. Free tiers and trials, where offered, are as described on the listing.

7. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, timely, or secure, or that reminders, nudges, or notifications will always be delivered. You are responsible for verifying anything time-sensitive.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you; in that case, such warranties are limited to the minimum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, AB Apps will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the App or these Terms, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App or these Terms will not exceed the greater of (a) the total fees you paid for the App in the twelve (12) months immediately before the event giving rise to the claim, or (b) fifty euros (€50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Indemnity

You agree to indemnify and hold harmless AB Apps from and against any claims, damages, and reasonable expenses arising from your misuse of the App or your breach of these Terms, to the extent permitted by applicable law.

10. Term and termination

These Terms apply while the App is installed. You may stop using and uninstall the App at any time; uninstalling deletes the App's data held in Forge storage, as described in the Privacy Policy. We may suspend or terminate the licence if you materially breach these Terms. Sections that by their nature should survive termination (including Sections 3, 7, 8, 9, and 11) survive.

11. Changes to these Terms

We may update these Terms to reflect new features, legal requirements, or platform changes. We will revise the "Last updated" date above and, for material changes, provide reasonable notice. Your continued use of the App after an update takes effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the European Union member state in which AB Apps is established (identified on request via support@abapps.dev), without regard to its conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction, except where mandatory consumer-protection law grants you the right to bring proceedings in your place of residence. If any provision is held unenforceable, the remaining provisions remain in full effect.
